Terms of Use

English Gateways International Pty Ltd (“Gateways”) provides you with an innovative language learning opportunity based on the use of interactive software, message boards, bulletin boards, chat rooms, email, information technology, educational activities, curriculum content, library facilities, on-line tutors, on-line librarians, this website, and other services (collectively, “The Service”). By using The Service you agree, without limitation, to be bound by, and to comply with, the following Terms of Use:

1. Reservation of Rights

  • This Agreement represents the entire contract between you and Gateways.
  • By using The Service as defined in the first paragraph above, you agree that this software and all images, audio, text, video, and informational items are made available for your private, non-commercial use and your continued right to use The Service will be subject to, and restricted by, these Terms of Use.
  • Gateways reserves the right to modify these Terms of Use from time to time, without notice. You are bound by any revisions made to these Terms of Use and, therefore, you should periodically review these Terms of Use so that you will be kept informed of any changes.
  • Gateways may use any components of The Service to provide particular online courses, modules, tailored courses and tailored modules (the “programs of study” or “study programs”) in which you may enrol.

2. Copyright

  • All material and intellectual property of Gateways used in the provision of The Service (including all text, images, software, content, audio and video files, documentation, and information technology) is the property of Gateways and is protected under international copyright, trademark, and intellectual property laws.
  • You may not copy, modify, translate, transmit, sell, redistribute or otherwise deal with The Service, or any portion of The Service, including study program contents, library contents, photographs, learning activities, website, articles, charts, quizzes, self-tests or reference materials, or use the content or software separate from The Service, without the express written permission of Gateways.

3. Payments, Security and Refund Policies

  • Tuition fees for programs of study for individuals may be found on the Gateways website. All fees are shown in Australian dollars. The fees listed do not include any Goods and Services Tax or other applicable taxes, and you will be responsible for paying any such taxes, currently calculated at an additional 10%, if you reside in Australia.
  • Organisations may negotiate prices and study programs for groups of students by contacting Gateways directly.
  • You agree that Gateways may include some or all of such taxes in your credit card charges, where applicable, and may change fees without notice. Fees will not be charged without notice.
  • Security of your personal information is of paramount importance to Gateways, and, if enrolling online, all credit card information is dealt with via a securely encrypted portal for transactions directly amongst banks. The key symbol shown on the Gateways website is a standard industry symbol which indicates that this is a secure website.
  • In the unlikely event that a program of study is cancelled by Gateways prior to commencement, Gateways offers a complete refund within two weeks of the cancellation.
  • If a program of study is cancelled by Gateways after commencement, Gateways offers a refund calculated according to the undelivered portion of the study program cancelled.
  • If Gateways does not accept your enrolment, Gateways will within two weeks of such a determination offer a full refund of your study program fees, less an administrative fee of $A100 (100 Australian dollars) which will be retained by Gateways.
  • No refund will be given after students have logged in to the Getting Started with Gateways Course.
  • You may request that any dispute, which cannot be resolved by discussion between you and Gateways, be resolved at a mediation conducted by an independent mediator, whose fees are to be paid equally by yourself and Gateways.
  • These Terms of Use do not remove your right to take further action under Australian consumer protection law.
  • Applications must be made in writing.

4. Your Representations and Responsibilities

  • By using The Service you acknowledge that you are an adult as defined by the laws of the country or territory from which you are accessing The Service. If you are younger than the age of adulthood in your country, you may enrol in Gateways programs of study if Gateways is provided with the written permission of your parent or guardian, and if payment for the programs of study is authorised by the parent or guardian.
  • You agree that your use of The Service is at your own risk, that any material and/or data downloaded or otherwise obtained through the use of The Service, the Messaging Services, or from other parties’ websites accessed via The Service is at your own discretion and risk, and that you will be responsible for any damage or loss of data to your computer system.
  • Please remember that you are responsible for maintaining the secrecy of your Gateways student number and student password, and that you are responsible for all activities relating to your email account. You agree to notify Gateways immediately of any unauthorised use of your Gateways email account.
  • This website may contain links to websites operated by other parties, and such links are provided for your convenience only. Gateways does not control or endorse any such websites, and you agree that Gateways is not responsible for their availability or their content.
  • You are responsible for all payments to Gateways under these Terms of Use, and for all charges associated with connecting and maintaining connection with all necessary telephone and Internet services. Gateways is not responsible for any loss arising from any failure of any telephone, line, network or internet connection.

5. Your Participation and Conduct

  • The message boards, bulletin boards, email, chat rooms, or other message services (“Messaging Services”) are public, not private, domains, and are provided to you and other users as an opportunity to communicate, practise your English language skills, prepare yourself for your tertiary studies, share ideas and images, discuss global issues, and learn about other countries.
  • Please stay on the relevant topic(s) and be courteous and respectful to your fellow users.
  • You agree not to use the Messaging Services for chain letters, junk mail, “spamming,” or solicitations (commercial or non-commercial). You also agree not to send any message or material that is improper, unlawful, defamatory, harassing, abusive, threatening, harmful, obscene, offensive, or otherwise objectionable.
  • You should assess the Messaging Services before using them. By using the Messaging Services, you agree that Gateways shall not be responsible for any content in the Messaging Services.
  • Gateways has no obligation to pre-screen or monitor the messaging content, and has the right, but not the responsibility, to remove any messaging content which it deems offensive, or otherwise in breach of the Terms of Use or any applicable rules or laws.
  • Gateways takes all reasonable measures to respect the privacy of all users’ messages, and you also agree to comply with all applicable laws and regulations concerning rights of privacy.
  • Viruses are to be actively avoided and you agree to maintain current anti-virus software at all times, and not to upload files or materials which contain viruses, corrupted files, or any other similar software which may damage the operation of another’s computer.
  • You are responsible for the originality of all material you submit to Gateways, and you agree to comply with all relevant intellectual property laws relating to software and messaging content.
  • You understand that the World Wide Web is public domain, and that this website reproduces materials for educational purposes; and therefore you agree that you may waive rights in connection with the messages or material you post, distribute, or use in the Messaging Services.

6. Termination

Gateways may terminate your use of The Service if you have provided false registration information, if you violate these Terms of Use, or if you fail to pay any amounts you owe under these Terms of Use.

7. Privacy Policy

  • Gateways is committed to protecting your privacy and security, and will not disclose to any other person your personal information, including your name, address, email address, and other details, except if necessary, with your consent or by legal obligation.
  • Your personal information is collected only when you knowingly and voluntarily submit it to Gateways.
  • All material placed by you on this website remains with the Gateways administrative system indefinitely and may be viewed at any time by Gateways.
  • Sometimes it may be considered valuable by Gateways to use, for educational purposes only, an example of material you have placed on the Gateways website. You may choose to prevent Gateways from using your work for educational purposes by informing Gateways now. Gateways would not identify you as the author of such material, unless you request acknowledgement of publicised works.
  • As stated previously under paragraph 3 of these Terms of Use, your credit card information is encrypted by a secure server used amongst banks before it is sent over the internet, and therefore is not actually received by Gateways if you enrol online.
  • Gateways may collect anonymous profile information from you (such as your age, profession, education, and gender) for use in identifying potential benefits to you from Gateways. You cannot be identified from such profile information.
  • Gateways will monitor activities at its website such as records of visits, and the times you log in and log out. This will be carried out using cookies, which contain data a website sends to your internet browser when you access information at that site. Cookies do not enable personal information to be identified or collected. Use of cookies for statistical analysis is standard industry practice. Most internet browsers support cookies and store them in a specific directory for potential collation purposes. However, if you wished to do so, software programs can be installed on your computer to reject cookies.

8. Disclaimers and Indemnity

  • Gateways may modify The Service without notice to you, and without liability to you or any other person.
  • Gateways will take all reasonable steps to provide The Service. However, Gateways will not be liable for any damages resulting from your use of or inability to use The Service, or from messages received or transactions entered into through The Service.
  • As a preliminary matter you agree to indemnify Gateways from any claims, liability, damages, and/or costs arising from your misuse of The Service, or your breach of these Terms of Use, or your infringement (or infringement by any other user of your online Gateways email account) of any intellectual property, or other right, of any person or entity.
  • Any opinions expressed in The Service are intended only to encourage discussion and language learning, and are based on materials which are in the public domain. To the best of Gateways’ knowledge, all information pertaining to real companies and individuals is accurate and not confidential at the time of publication, and is included for educational purposes only. Some information used by Gateways for educational purposes may be of a hypothetical nature.

9. Miscellaneous

  • The Service is controlled by Gateways from its offices in the state of Victoria, Australia. It can be accessed from around the world. As each user may be from places with laws which differ from those of Australia, by accessing and using The Service, both you and Gateways agree that the laws of the State of Victoria will be the governing laws relating to these Terms of Use.
  • You agree that in the unlikely event of a dispute not being resolved, the jurisdiction and courts of Victoria, Australia are the applicable jurisdiction and courts.
  • Any waiver of any provision of these Terms of Use will be effective only if in writing and signed by Gateways. A printed version of these Terms of Use and of any notice given in electronic form shall be admissible in court hearings relating to these Terms of Use.
